The Montenegrin court accepted its request for bail from Terra founder Do Kwon after the previous annulment performed by a higher court, according to a recently released official announcement. On March 23, Kwon, and a former Terra executive, Han Chang-joon, were arrested in Montenegro for allegedly having forged documents.
“The Higher Court of Podgorica, by decision of 18.05.2023. accepted the appeal of the Public Prosecutor's Office of the Basic State in Podgorica and canceled the decision of the first instance of the Basic Court in Podgorica on 12 May 2023. Koreans accused of the crime of document forgery, along with which the court also imposed a measure of probation – prohibition to leave the apartment, and returned the case to the court for a new decision”, says part of the release.
According to the document, the Basic Court in Podgorica issued a new decision, on June 2, in which it accepted the bail offered in the amount of 400.000,00 euros for each of those involved and also determined a surveillance measure - a ban on leaving the apartment, which should be held by the police.
“In making this decision, the court took into account the evidence on the financial situation of the defendants presented by their lawyers, the seriousness of the crime for which the defendants are reasonably suspected, their personal and family situation, as well as the financial situation situation of people who provide bail, and the opinion of the representative of the prosecution.Base of the State Prosecutor's Office in Podgorica. The court appreciated the fact that they are people who are not Montenegrin citizens, which is why it accepted their statements about the value of the property they own,” the court highlighted.
In addition, the court also informed that it considered the need to take additional measures to verify the authenticity of travel documents and identity cards allegedly issued by the competent authority of Belgium.
